Welcome to the General Transport Terms and Conditions of Transvolando, S.L.. Here you will find the terms governing our road freight services, organised by vehicle type and featuring our new Basic, Standard and Premium packages tailored to the urgency and commitment level your shipment requires.
These terms apply to every quote issued from 1 January 2026 onwards and incorporate the updated figures of Article 22 of the LCTTM (Spanish Law 15/2009 on the Land Freight Transport Contract) referenced to the 2026 IPREM. The Basic, Standard and Premium package system
With every quote we issue we offer you three clearly differentiated packages so you can choose according to your priority:
- Basic: the most economical option, subject to actual fleet availability. Designed for non-urgent shipments where the loading window is flexible (up to 5 calendar days) and customer service is by email within 48 working hours.
- Standard (recommended): the balance between price and commitment. Loading window opens within 2 calendar days, 4-hour time slot, customer service by email and telephone within 24 hours, online document manager with 30-day access.
- Premium: the most complete package. You choose the exact day and time of loading and delivery, dedicated contact with direct mobile, immediate response by phone or WhatsApp, document manager with permanent access, extended insurance and the Transvolando Premium Guarantee (commitment on lead time, communication and incident resolution detailed at the end of this page).
The specific differences between the three packages for each vehicle type are detailed in each section and in the quote table you receive.
1. Groupage
Service in a shared trailer where your goods travel alongside other consignments in the same vehicle. It reduces the cost per pallet or per item compared to a full trailer and is the most efficient option for small to medium-sized shipments.

Goods excluded from groupage: flammable, explosive, dangerous (ADR not included) and refrigerated.
2. Vans
Dedicated service in a closed or side-loading van, ideal for urgent, exclusive or low-volume shipments where contracting groupage or a larger vehicle would not be cost-effective.

Van capacities
- Van up to 1,000 kg (closed): 3 m long × 1.2 m wide × 1.7 m high (1–3 EU pallets)
- Van up to 1,200 kg (closed or side-loading): 4 m × 2 m × 2.1 m (4–6 EU pallets)
3. Rigid Lorry
Dedicated service in a rigid lorry of 3,000 to 16,000 kg payload, with box trailer, curtain-sider or low-side body according to the shipment requirements.

Rigid Lorry capacities

4. Full Trailer Load (FTL)
Dedicated service in a full trailer of 24,000 kg payload using a curtain-sider or closed box trailer depending on the package contracted. The full demurrage and indemnification regime of Article 22 LCTTM applies.

Demurrage and indemnification (Article 22 LCTTM — updated 2026)
Demurrage is calculated from the 2nd hour onwards (the first hour is free), Monday to Saturday, with a maximum of 10 chargeable hours per day. Tariffs are tiered according to the number of days the demurrage is prolonged (base 2026 IPREM × 2):

- Standard service with less than 24 h notice: 400 € (48 h in Andalusia and Extremadura).
- Generic vehicles with less than 48 h notice: 500 €.
5. Heavy Machinery and Abnormal Loads
Dedicated service for specialised transport of heavy machinery and out-of-gauge cargo: open flatbed, reinforced flatbed, curtain-sider or step-frame trailer (lowboy) according to the weight and dimensions of the load. Loads up to 24,000 kg. Special permits and pilot car on demand.

- Mandatory pilot car (anchura > 3 m · altura > 4,5 m · peso > 60 t): 25 €/h o 210 €/jornada.
- Special DGT permit (TRAZA): €230/permit.
- Exceptional permit (peso > 110 t): 450 €/permiso.
Cancellation indemnification · Standard machinery
Cancellation with less than 48 h notice: 600 € + permits contracted + pilot car if applicable.
Cancellation · Step-frame trailers and out-of-gauge vehicles (reinforced clause)
For step-frame trailers and out-of-gauge transports, cancellation with less than 24 hours notice means the customer forfeits the entire haul amount. As a minimum the following will be charged: vehicle deployment to the loading point + 800 € + €1.80/km return to base + permits contracted + pilot car if applicable.
Transvolando Premium Guarantee
Tiered commitment on lead time, communication and incident resolution applicable exclusively to the Premium package. If we fail you, we compensate you automatically and proportionally to the impact. This is what we sign with you when you contract the Premium package.
01. Delivery lead time
- Delay of 4 to 6 h beyond the agreed time → 15% credit applicable to your next shipment.
- Delay of 6 to 12 h → 30% credit applicable to your next shipment.
- Delay over 12 h → 50% credit on next shipment + 10% refund to the original payment method.
02. Guaranteed communication
Working hours: Mon–Fri 09:00–18:00, excluding Spanish national bank holidays and Madrid regional holidays. If you call and we do not answer within 30 minutes, we call you back and apply €10 credit per hour until we attend you, with a cap of €50 per incident.
03. Claims
- Claim filing window: 10 calendar days from delivery.
- Resolution timeframe on our side: maximum 10 calendar days from receipt (better than the 21 days set out in Article 60 LCTTM).
Excluded by force majeure: unforeseeable mechanical breakdowns, extraordinary traffic congestion, extreme weather, customs hold-ups, sectoral strikes, road traffic accidents not caused by the haulier, and unforeseen traffic restrictions.
Air freight and dangerous goods
For shipments by air freight (urgent international) and dangerous goods (ADR) additional specific conditions apply:
- Restrictions by cargo type and packaging according to IATA / ADR regulations.
- Supplementary documentation: shipper's declaration, safety data sheet, UN labelling.
- Quotes are always individualised (the online calculator does not apply). Please request a quote at info@transvolando.es.
- The general demurrage and indemnification regime of the Full Trailer Load applies wherever it is compatible with the specific regulation.
General terms applicable to all services
Quote · Includes
- LOTT insurance (domestic transport) or CMR insurance (international transport) up to €90,000/haul. Not all-risk cover.
- Loading and unloading times according to the package contracted (1 h or 2 h each).
Quote · Does not include
- VAT or other taxes.
- Specified loading / unloading time unless previously agreed.
- Urban permits or municipal fees.
- Customs hold-ups: €35–55/h (max. €400–550/day).
- Prior certification of vehicle access viability at the loading / unloading point (customer's responsibility).
Goods
Pickups and deliveries on the ground floor, kerbside. ADR (dangerous goods) NOT included unless specifically requested. Pallets correctly packed, identified with sender, recipient and reference number.
Insurance
LOTT/CMR cover up to €90,000/haul. For higher values a written prior valuation and an all-risk insurance supplement are required.
Validity of tariffs and quotes
Quotes issued are valid for 30 calendar days from the date of issue.
Price revision due to fuel price variation (Article 38 LCTTM)
In accordance with Article 38 of Law 15/2009 on the Land Freight Transport Contract, as amended by Royal Decree-Law 3/2022 of 1 March, the contracted transport price will be automatically revised upwards or downwards when, between the date the contract is signed (or the quote is issued) and the date the service is actually performed, the diesel price has varied by an amount equal to or greater than 5 % (or any lower percentage the parties may have agreed).
The revision is calculated using the formula published by the Spanish Ministry of Transport and Sustainable Mobility in the general conditions for road freight transport contracts. The transport invoice will always show the fuel cost separately when this clause comes into play.
This clause is mandatory under the current legal framework: any agreement to the contrary is null and void. It applies both to one-off contracts and to ongoing traffic contracts, regardless of the package contracted (Basic, Standard or Premium).
Force majeure
We are not liable for delays or non-performance caused by force majeure: unforeseeable mechanical breakdowns, extraordinary traffic congestion, extreme weather, customs hold-ups, sectoral strikes, accidents not caused by the haulier, unforeseen traffic restrictions and other unforeseen circumstances.
Conflict resolution
In the event of a dispute, the parties submit to arbitration before the Madrid Transport Arbitration Boards (Juntas Arbitrales de Transporte de Madrid).
23. Non-Circumvention, Non-Compete and Confidentiality
23.0. Acceptance. By accepting the quotation issued by TRANSVOLANDO, S.L. — whether by express written response (email, message, letter), by recorded verbal confirmation, by commencement of service execution (delivery of goods to the carrier, authorisation of collection, communication of loading date) or by payment — the CLIENT expressly accepts all of these Conditions, with particular attention to Clause 23, which has been referenced in the body of the quotation and is fully enforceable against the CLIENT even without a handwritten signature, in accordance with Articles 1262 and 1278 of the Civil Code, Article 51 of the Commercial Code and Article 5 of Law 7/1998 on General Contracting Conditions.
23.1. Definition. For the purposes of this clause, the following term shall be understood as «Carrier Introducido» any carrier, operator, driver or transport company that TRANSVOLANDO, S.L. presents, recommends, assigns or subcontracts for the provision of a service to the CLIENT, as well as any natural or legal person linked to said carrier (subsidiaries, group companies, self-employed collaborators).
23.2. Non-circumvention commitment. The CLIENT undertakes, for the duration of the commercial relationship with TRANSVOLANDO, S.L. and for a period of twenty-four (24) months following the date of the last invoiced service, NOT to engage directly or indirectly — through third parties, affiliated companies, subsidiaries, employees, agents or intermediaries — the transport services of any Introduced Carrier, without the contractual and commercial mediation of TRANSVOLANDO, S.L.
23.3. Confidentiality and trade secret. The identity, contact details, commercial terms, capacities, administrative authorisations, regular routes and any other data relating to the Introduced Carriers are considered to be confidential information and trade secret protected by Spanish Law 1/2019 of 20 February on Trade Secrets. The CUSTOMER undertakes not to disclose, divulge, commercially exploit or use such information for purposes other than the performance of the transport contract in force with TRANSVOLANDO, S.L.
23.4. Liquidated damages (Art. 1152 Spanish Civil Code). Breach of the commitments set out in Sections 23.2 and/or 23.3 shall automatically entitle TRANSVOLANDO, S.L., without prior notice or proof of loss, to claim from the CLIENT a lump-sum compensation equivalent to the greater of the following amounts: (a) the two hundred per cent (200%) of the total amount invoiced in the last twelve (12) months to the CLIENT for services rendered with the Introduced Carrier affected; or (b) a minimum of five thousand euros (€5,000) for each transport operation carried out in circumvention. This compensation constitutes substitutive penalty clause of damages (Art. 1152 CC), without prejudice to the right of TRANSVOLANDO, S.L. to claim additional damages if the actual losses exceed this amount, and without prejudice to the unfair competition actions provided under Articles 14 and 32 of Law 3/1991, of 10 January, on Unfair Competition.
23.5. Express acknowledgement. The CLIENT acknowledges that TRANSVOLANDO, S.L.'s carrier network constitutes a business asset resulting from ongoing investment in prospecting, accreditation, regulatory compliance monitoring (LOTT, LCTTM, ADR, CMR), insurance verification and document checks, and that circumvention of this network by the CLIENT causes a certain, quantifiable and foreseeable financial loss.
23.6. Severability. The nullity or invalidity of any part of this clause shall not affect the validity of the remaining parts. The non-circumvention undertakings, confidentiality obligations and the contractual penalty shall survive by their nature upon termination of the contract.
24. NON-SOLICITATION, NON-COMPETE AND CONFIDENTIALITY BY THE CARRIER
24.0. Acceptance. By accepting the Load Order issued by TRANSVOLANDO, S.L. — whether by express written response (email, message, letter), by recorded verbal confirmation, by commencement of service execution (presentation for loading, collection of goods, communication of loading date) or by any other unequivocal act — the CARRIER expressly accepts all of these Conditions, with particular attention to Clause 24, which has been referenced in the body of the Load Order and is fully enforceable against the CARRIER even without a handwritten signature or physical stamp, in accordance with Articles 1262 and 1278 of the Civil Code, Article 51 of the Commercial Code, Article 5 of Law 7/1998 on General Contracting Conditions and Regulation (EU) 910/2014 (eIDAS) on electronic identification and trust services.
24.1. Definition. For the purposes of this clause, the following term shall be understood as "Introduced End Client" any shipper, consignee, factory, warehouse, loading or unloading facility, contracting party or third party that the CARRIER accesses as a result of a Load Order issued by TRANSVOLANDO, S.L., as well as any natural or legal person linked to said end client (subsidiaries, group companies, employees, agents or intermediaries).
24.2. Non-solicitation commitment. The CARRIER undertakes, for the duration of its commercial relationship with TRANSVOLANDO, S.L. and for a period of twenty-four (24) months following the date of the last Load Order executed, NOT to contact, contract, solicit, serve, provide services or manage transport — directly or indirectly, on its own behalf or on behalf of others, through third parties, affiliated companies, subsidiaries, employees, agents, intermediaries or professional networks — with any Introduced End Customer, without the express contractual and commercial mediation of TRANSVOLANDO, S.L.
24.3. Mandatory redirection of communications. Any communication, contact, request or commercial approach received by the CARRIER from the Introduced End Customer — by telephone, WhatsApp, email, social media or any other channel — must be redirected to the Traffic Department of TRANSVOLANDO, S.L. within a maximum period of twenty-four (24) hours, without providing the end customer with the CARRIER's own details or details of the contractual operation with TRANSVOLANDO, S.L. The CARRIER and its drivers are strictly prohibited from providing business cards, their own telephone numbers, direct quotations or any commercial information.
24.4. Confidentiality and trade secret. The identity, contact details, commercial terms, routes, frequencies, commercial contacts and any other data relating to the Introduced End Customers are considered to be confidential information and trade secret protected by Spanish Law 1/2019 of 20 February on Trade Secrets. The CARRIER undertakes not to disclose, divulge, copy, store, commercialise, commercially exploit or use such information for purposes other than the performance of the transport contract in force with TRANSVOLANDO, S.L. This obligation survives indefinitely after termination of the contract.
24.5. Liquidated damages (Art. 1152 Spanish Civil Code). Breach of the commitments set out in Sections 24.2, 24.3 and/or 24.4 shall automatically entitle TRANSVOLANDO, S.L., without prior notice or proof of loss, to claim from the CARRIER a lump-sum compensation equivalent to the greater of the following amounts: (a) the two hundred per cent (200%) of the total amount invoiced by TRANSVOLANDO, S.L. to the Introduced End Customer in the last twelve (12) months; or (b) a minimum of five thousand euros (€5,000) for each transport operation carried out in circumvention. This compensation constitutes substitutive penalty clause of damages (Art. 1152 CC), without prejudice to the right of TRANSVOLANDO, S.L. to claim additional damages if the actual losses exceed this amount, and without prejudice to the unfair competition actions provided under Articles 14 and 32 of Law 3/1991, of 10 January, on Unfair Competition.
24.6. Joint and several liability. Si el Introduced End Customer and the CARRIER collaborate or conspire to circumvent, both shall be jointly and severally liable jointly and severally liable ante TRANSVOLANDO, S.L. de la pena convencional prevista en el apartado 24.5, sin perjuicio de las responsabilidades adicionales que pudieran corresponder.
24.7. Express acknowledgement. The CARRIER acknowledges that TRANSVOLANDO, S.L.'s portfolio of End Clients constitutes a business asset resulting from ongoing investment in commercial prospecting, client acquisition, loyalty programmes, quality control and after-sales service, and that circumvention of this portfolio causes a certain, quantifiable and foreseeable financial loss that justifies the automatic and lump-sum nature of the agreed contractual penalty.
24.8. Severability and survival. The nullity or invalidity of any part of this clause shall not affect the validity of the remaining parts. The non-solicitation undertakings, confidentiality obligations, communication redirection duties and the contractual penalty shall survive by their nature upon termination of the contract.
Requesting our services constitutes acceptance of these terms.
